Refund Policy

At tests&funnels, we are committed to delivering high-quality digital marketing, branding, production, technology, and creative services. As our services involve dedicated planning, resource allocation, intellectual effort, and customized execution, this Refund Policy outlines the terms governing refunds, cancellations, and service termination.

By engaging our services, the Client acknowledges and agrees to the terms stated below.

1. Advance Payments & Retainers

All advance payments, retainers, booking amounts, and milestone payments are collected to reserve dedicated team bandwidth, project timelines, creative resources, production schedules, and operational capacity.

Accordingly, such payments are made against resource allocation and project commencement and shall not be considered refundable merely because the Client chooses not to continue with the project after confirmation.

2. Strategy, Planning & Creative Work

The following activities constitute billable professional services irrespective of whether the Client proceeds with implementation or grants final approval:

  • Discovery sessions
  • Strategy consultations
  • Business research
  • Market analysis
  • Competitor analysis
  • Brand positioning
  • Creative brainstorming
  • Mood boards
  • Content planning
  • Campaign planning
  • Wireframes
  • Website planning
  • Funnel planning
  • Brand identity exercises
  • Creative concepts
  • Scripts
  • Marketing strategies
  • Any advisory or consulting services

The value of these services shall be considered earned upon completion and shall not be refundable.

3. Refunds After Project Commencement

Once a project has commenced, all payments corresponding to work completed, resources deployed, or services rendered shall be non-refundable.

Project commencement includes, but is not limited to:

  • Strategy sessions
  • Internal planning
  • Research
  • Design
  • Development
  • Production
  • Editing
  • Campaign setup
  • Content creation
  • Resource allocation
  • Client meetings
  • Consultations

4. Project Pause, Postponement or Scope Reduction

If the Client:

  • pauses the project,
  • postpones project execution,
  • delays approvals,
  • becomes non-responsive,
  • reduces the agreed scope,
  • or requests suspension of services after work has commenced,

without prior written notice and mutual agreement, the fees for the ongoing billing cycle or running month shall remain payable and non-refundable.

Project timelines may consequently be revised based on team availability.

5. Photography & Videography Services

Photography, videography, and production bookings involve advance scheduling of production crews, equipment, studios, locations, editors, and creative personnel.

Accordingly:

  • Once a shoot has been scheduled, production resources are considered reserved.
  • If the Client reduces the planned number of deliverables during or immediately before the scheduled shoot, such reduction shall not automatically reduce the agreed commercial value of the project.
  • Any revision in commercial terms shall only be valid if mutually agreed upon in writing by both parties before execution.

6. Creative Deliverables & Revisions

Creative services are inherently subjective.

tests&funnels shall provide revisions as specifically mentioned in the applicable proposal, quotation, or agreement.

Requests arising solely from changes in personal preference, creative taste, internal stakeholder opinions, or evolving business decisions shall not constitute grounds for refunds.

Any revisions beyond the agreed scope may attract additional charges.

7. Refund Calculation (If Approved)

Refunds are not an entitlement and shall be granted solely at the absolute discretion of tests&funnels.

Where a refund is exceptionally approved, the refundable amount shall be determined only after deducting the value of:

  • Strategy and consulting
  • Research and planning
  • Project management
  • Meetings and consultations
  • Creative concepts
  • Content planning
  • Branding exercises
  • Design work
  • Development work
  • Production
  • Photography
  • Videography
  • Editing
  • AI-generated content
  • Software subscriptions
  • Third-party expenses
  • Travel expenses
  • Vendor costs
  • Administrative expenses
  • Taxes (where applicable)
  • Any other work already completed

The Company’s decision regarding refund calculations shall be final.

8. Communication & Approvals

To avoid ambiguity, all approvals, revision requests, project feedback, scope changes, extensions, pauses, and commercial discussions must be communicated in writing through:

  • Email; or
  • Official WhatsApp communication with the designated project manager or representative.

Verbal discussions shall not be treated as binding unless subsequently confirmed in writing.

9. Cancellation & Termination of Services

The Client may discontinue ongoing services by providing a minimum written notice of fifteen (15) calendar days.

Termination requests received without the required notice period shall be treated as immediate termination.

In such cases:

  • Fees for the running month shall remain payable.
  • No refund shall be applicable for services already scheduled, initiated, or completed.
  • Reserved production resources and allocated manpower shall continue to be chargeable.

10. Immediate Termination

In case of immediate termination by the Client without serving the mandatory fifteen (15) days’ prior written notice:

  • No refund shall be issued.
  • Any outstanding invoices shall immediately become due and payable.
  • tests&funnels reserves the right to suspend all ongoing work until outstanding dues are cleared.

11. Non-GST Payments

Payments made outside the applicable GST-compliant invoicing process, including but not limited to payments where GST has not been charged or collected as per the agreed commercial arrangement, shall not be eligible for any refund under any circumstances.

12. Third-Party Costs

Any payments made towards third-party services, including but not limited to:

  • Advertising platforms
  • Domain registrations
  • Hosting
  • Software subscriptions
  • Premium plugins
  • Stock assets
  • Printing
  • Influencer fees
  • Vendor payments
  • Media buying
  • Logistics
  • Any government fees

are non-refundable once incurred.

13. Force Majeure

tests&funnels shall not be liable for delays, interruptions, or inability to perform services arising from events beyond its reasonable control, including but not limited to natural disasters, governmental actions, internet failures, strikes, pandemics, or acts of God.

Refunds shall not arise solely on account of such circumstances.

14. Governing Law

This Refund Policy shall be governed by and construed in accordance with the laws of India.

Any disputes arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the competent courts having jurisdiction over the registered office of tests&funnels.
